What is the Statute of Limitations on Florida Personal Injury Cases?

Suffering through an accident can lead to tremendous pain, stress, and suffering for you and your loved ones. In Florida, the statute of limitations on personal injury cases is 2 years for medical malpractice or wrongful death, and 4 years for other personal injury claims. What Do I Do After an Accident?


Make Sure you are in a safe area.

If you are in a high traffic area, move your vehicle to a safe area closest to where the accident occurred. Do not leave the scene of the accident. 


Call 911.

Call 911 to report the accident and any injuries you have sustained. Report any injury or soreness to the police officer and seek medical attention if needed. 


Take Photos, Get Witness Testimonies, Keep Conversation to a Minimum.

Take pictures of any damage to your vehicle, the other party’s vehicle, license plate, surrounding area where the accident happened, and any debris from the accident.

If there are any witnesses, get their name, phone numbers and have the police officer take their statement. This will assist when building your case.

Keep conversation with the other driver to a minimum. Let the police officer do the talking.

Every case is unique but under Florida law you can be compensated under two specific categories:
Compensatory damages- Economic & Non-economic damages
Punitive damages

Punitive damages are a type of financial penalty that’s used by the court system to punish the responsible party if they believe that gross negligence played a role in the accident.
